Article 1 – Definitions
Agreement: the agreement between Stoked Amsterdam and the Client regarding the provision of a Service.
Client: the (legal) person with whom Stoked Amsterdam has entered into an Agreement.
Consumer: the Client who is a natural person and who is not acting in the exercise of a profession or business.
Service: a service provided by Stoked Amsterdam focussed on physical, educational and/or social activity.
Staff: an employee, freelancer or other professional contracted by Stoked Amsterdam.

Article 2 – Applicability
These general terms and conditions are applicable to all legal relationships between Stoked Amsterdam and the Client. Deviations are only valid if explicitly agreed in writing. The applicability of any purchasing conditions of the Client is explicitly rejected.
Article 3 – Offer
Offers are published on www.stokedcommunity.com or issued directly to the Client. Each offer is valid for the indicated period, or maximum two (2) weeks if no period is stated.
Article 4 – Agreement
An Agreement is formed upon acceptance by the Client and confirmation by Stoked Amsterdam. Agreements are strictly personal and cannot be transferred without explicit written consent from Stoked Amsterdam.
Article 5 – Reflection period for Consumers
Consumers may cancel the Agreement free of charge within fourteen (14) calendar days of formation. To cancel, send the completed withdrawal form (Appendix 1) to info@stokedcommunity.com.
Article 6 – Duration
The Agreement is entered into for an indefinite period unless explicitly agreed otherwise.
Article 8 – Time and location
Performance takes place at the time and location indicated by Stoked Amsterdam. Late cancellations may result in refusal of access. Any additional costs resulting from acts or omissions of the Client will be charged to the Client.
Article 10 – Obligations of the Client
The Client must follow Stoked Amsterdam's codes of conduct, inform Stoked of any medical contraindications, follow staff instructions, and not use facilities under the influence of alcohol, drugs or doping substances. No smoking on premises.
Article 11 – Prices
All prices include VAT. Stoked Amsterdam may adjust prices at any time with at least four (4) weeks' notice. Consumers may terminate the Agreement within four (4) weeks of a price increase notification.
Article 12 – Payment
Fees are collected monthly in advance via direct debit. In case of late or failed payment, statutory interest and extrajudicial costs may be charged. Stoked Amsterdam may suspend services until outstanding amounts are settled.
Article 14 – Changes by the Client
Clients may upgrade, downgrade or pause their membership. Pausing requires at least one (1) month notice, starts on the first day of a calendar month, and has a minimum duration of one (1) month. Request via info@stokedcommunity.com.
Article 15 – Termination
Both parties may terminate with one (1) calendar month notice, starting the first day of the following month. Stoked Amsterdam may terminate immediately if the Client violates these terms or shows unacceptable behaviour.
Article 17 – Liability of Stoked Amsterdam
Clients use Services at their own risk. Stoked Amsterdam is not liable for (sports) accidents, injuries, or theft of property. Liability is limited to the amount paid out under Stoked Amsterdam's insurance policy.
Article 20 – Complaints
Complaints must be submitted in writing within four (4) weeks of identifying the shortcoming. Stoked Amsterdam will respond within four (4) weeks of receipt.
Article 21 – Personal data
Stoked Amsterdam processes personal data in accordance with the GDPR. See the privacy statement on www.stokedcommunity.com for more information.
Article 23 – Governing law
Dutch law applies. Disputes will be settled by the competent court in Amsterdam. Drawn up on October 17, 2022.
Appendix 1 – Withdrawal form
To cancel, send the following information to info@stokedcommunity.com:
- Notice of withdrawal from the Agreement
- Service ordered / received on (date)
- Your full name and address
- Date
